Service Company and Debt Collector Sued for Charging Repair Costs and Ignoring Warranty

Florida Consumer Lawyers sued and won a case against a large Florida refrigeration service company and a national debt collector due to their charging client thousands of dollars in repair costs for a repairs made to a commercial grade icemaker that should have been covered under the warranty. The ice maker was purchased by an avid saltwater fisherman to strictly use as part of his of his fishing setup. Within a year of purchasing the icemaker it broke down. He contacted the manufacturer who refereed him to a statewide service company. The service company made the repairs and told him it would be covered by the warranty. A short time later the client received an invoice for repairs that were approximately 75% of the total cost of the icemaker. When client called the servicer to discuss they were rude and completely blew him off. A few months later, the client started receiving letters and phone calls from a national debt collector. After getting nowhere with the debt collector, the client contacted Florida Consumer Lawyers for a free consultation. After reviewing the warranty and the repair invoice we concluded that the service company and the debt collector violated Florida's Consumer Collections Practices Act and the Fair Debt Collections Practices Act. Shortly after filing the lawsuit the servicing company and the debt collector agreed to our demands for settlement. The client received the maximum statutroy damages and actual damages for the stress of dealing with the debt collector
