Florida Consumer Lawyers recently sued a major Florida hospital chain for over billing or "balance billing" one of our auto accident clients after their personal injury protection (PIP) insurance covered the emergency room bills. Our client was in a car accident and went to the emergency room. The hospital received full benefits under the client's PIP insurance and by law they were obligated to write-off balance. Instead, the hospital sent the client a bill for the full balance of $10,000 and threatened to send him to collections if he didn't pay. Florida Consumer Lawyers brought a lawsuit under the Florida Consumer Collections Protection Act (FCCPA) and the hospital settled the case without filing an Answer. The client received statutory damages as well as actual damages for the stress and aggravation caused.
